Notice Period Calculator
Work out how much notice you need to give when you resign, from the clause in your award, and the minimum notice your employer must give you under the National Employment Standards. The two are set in different places. Section 117 of the Fair Work Act covers only an employer ending the job, so resignation notice comes from the award: 25 of the 26 awards covered here use a table of 1 to 4 weeks by service, and the Educational Services (Teachers) Award 2020 asks for 7 term weeks in a school. An employer owes 1 to 4 weeks, plus 1 week for an employee over 45 with 2 years of service, worked or paid out at the full rate of pay.

Clause 37.1(b) of the General Retail Industry Award 2020 sets it by your continuous service at the end of the day you give notice. You do not add the extra week an employer adds for someone over 45. If you leave without it, clause 37.1(d) lets your employer deduct no more than 1 week of wages, and clause 37.1(f) says any deduction must not be unreasonable.
Worked examples, with the arithmetic.
The same sums the tool runs, on real figures. Every number below is computed by the tested engine from the published rates, so the prose and the tool can never disagree.
How much notice do you give after two and a half years in retail?
2 years 6 months of service = More than 1 year but not more than 3 years clause 37.1(b) = 2 weeks clause 37.1(d): 1 x $1,100 = $1,100 most deducted
Under the General Retail Industry Award 2020, an employee with 2 years and 6 months of service must give 2 weeks of notice, from the table in clause 37.1(b). Leave with less and clause 37.1(d) lets the employer deduct no more than 1 week of wages, $1,100 on $1,100 a week, and only from age 18 and where the employer did not agree to a shorter period.
How much notice must an employer give a 50-year-old after 6 years?
6 years, more than 5 = 4 weeks under s 117(3) over 45, 2 years' service = +1 week, 5 weeks 5 weeks x $1,500 full rate = $7,500 in lieu $7,500 x 32% = $2,400 withheld
Six years is more than 5, which is 4 weeks under the Fair Work Act, and being over 45 with at least 2 years of service adds 1 week, so the minimum is 5 weeks. Paid out at a full rate of $1,500 a week that is $7,500. As an employment termination payment outside a redundancy, Schedule 11 withholds 32% of it, $2,400, leaving $5,100, while the whole-of-income cap left after the year's other taxable payments stays above the payment.
Why does the notice period change the day after an anniversary?
notice on the 3rd anniversary = 2 weeks, "More than 1 year but not more than 3 years" notice the day after = 3 weeks, "More than 3 years but not more than 5 years"
The Fair Work Act table and the award tables both run on "more than" and "not more than", and service is counted at the end of the day notice is given. Notice given on a third anniversary is therefore still 2 weeks, and notice given the next day is 3 weeks. The same step happens at 1 year and at 5.
How much notice does a school teacher give when resigning?
clause 32.3(a) follows 32.1(b) = 7 term weeks clause 32.3(b): 2 x $2,000 = $4,000 most deducted
Under the Educational Services (Teachers) Award 2020 a teacher resigns on the same notice the employer must give, which clause 32.1(b) sets at 7 term weeks in a school. Leave with less and clause 32.3(b) lets the employer deduct no more than 2 weeks of wages, $4,000 on $2,000 a week, with no age condition. Outside a school, clause 32.2(b) sets 4 weeks, or 4 preschool term weeks in a preschool.
Is this accurate, and how does it work?
The method is published rather than described. Nothing here is a black box, and the limits are listed as plainly as the workings.
- 1Work out who is giving notice. Section 117 of the Fair Work Act sets the notice an employer must give before ending a job, and nothing for an employee who resigns. Every one of the 26 awards here notes that the NES deals with notice by an employer, then sets the employee's notice in a clause of its own headed "Notice of termination by an employee". Without an award, resignation notice is whatever the employment contract or enterprise agreement says.
- 2Count continuous service at the end of the day notice is given. The Act and the award tables both run on "more than" and "not more than": 1 week for up to 1 year of service, 2 weeks for more than 1 and up to 3 years, 3 weeks for more than 3 and up to 5 years and 4 weeks for more than 5 years. An anniversary itself stays in the lower band, so notice given on a third anniversary is 2 weeks and notice given the next day is 3 weeks. The standard award clause gives continuous service the same meaning as in section 117.
- 3Read the award's resignation clause. 25 awards carry the Fair Work Commission's standard clause: the same table an employer works from, except that an employee never adds the week for age. The Fast Food Industry Award 2020, Hair and Beauty Industry Award 2020 and Pharmacy Industry Award 2020 word that note differently, tying the age week to an employee over 45 with 2 years of continuous service, which leaves the figures the same. The Educational Services (Teachers) Award 2020 is the exception. Clause 32.3(a) asks a teacher for the same notice the employer must give: 7 term weeks in a school under clause 32.1(b), and 4 weeks elsewhere, or 4 preschool term weeks in a preschool, under clause 32.2(b).
- 4Check what can be deducted if you leave early. Under the standard clause, an employee aged 18 or over who gives less notice than the table requires can have no more than 1 week of wages deducted from what is owed under the award. Nothing can be deducted if the employer agreed to the shorter notice, and any deduction must not be unreasonable in the circumstances. The Teachers award allows up to 2 weeks of wages and sets no age. The Hospitality Industry (General) Award 2020 adds clause 41.1(g): the employer may pay out all or part of the notice an employee gives instead of having it worked, at the amount section 117 would require had the employer ended the job.
- 5Add the NES minimum for an employer. An employer must give 1 week for up to 1 year of service, 2 weeks for more than 1 and up to 3 years, 3 weeks for more than 3 and up to 5 years and 4 weeks for more than 5 years, plus 1 week for an employee over 45 with at least 2 years of service. Probation does not remove it: Fair Work's example is Gunter, dismissed 5 months into his probation, who is owed 1 week. The Teachers award sets more, inclusive of the NES: 7 term weeks in a school and 4 weeks elsewhere.
- 6Check the exclusions. Notice does not apply to casual employees; employees employed for a specific period of time, season or task; employees dismissed for serious misconduct; trainees other than apprentices employed for a set period or for the length of the training arrangement; daily hire employees in building and construction or in the meat industry in connection with the slaughter of livestock; or weekly hire employees in the meat industry whose employment ends only because of seasonal factors. An apprentice gets notice unless employed for a set period or dismissed for serious misconduct. The award clauses leave out the same employees, so an excluded employee owes no award notice on resigning either.
- 7Pay notice out at the full rate. An employer can pay instead of giving notice. Section 117(2)(b) sets the payment at the full rate of pay for the hours you would have worked until the end of the notice period, so loadings, allowances, overtime and penalty rates count. The weekly figure you enter is treated as that full rate, which makes the result a floor if your weeks vary.
- 8Withhold tax on a payment in lieu. A payment instead of notice is an employment termination payment. In the ATO's own worked example, notice pay that would have been paid on any departure is a non-excluded ETP, so Schedule 11 withholds 32% up to the smaller of the $270,000 ETP cap and the $180,000 whole-of-income cap less the year's other taxable payments, 17% instead if you are 60 or over on 30 June 2027, and 47% above the cap, rounded to the dollar. In a genuine redundancy the ATO says the redundancy payment may include pay in lieu of notice, depending on the employment conditions, so for a redundancy the calculator stops at the notice figure and the Redundancy Calculator takes it from there.
Notice by length of service.
Service is counted at the end of the day notice is given, and each band starts the day after an anniversary. The employee column is the standard award clause, which repeats the employer table without the week for age.
| Continuous service | Employer gives, s 117(3) | Over 45 with 2 years | Employee gives, standard clause |
|---|---|---|---|
| Not more than 1 year | 1 week | Not yet 2 years | 1 week |
| More than 1 year, not more than 3 years | 2 weeks | 3 weeks | 2 weeks |
| More than 3 years, not more than 5 years | 3 weeks | 4 weeks | 3 weeks |
| More than 5 years | 4 weeks | 5 weeks | 4 weeks |

What this does not cover.
- It reads the 26 awards this site holds, each at the consolidation shown in the table below. An enterprise agreement or employment contract can set its own notice, so check yours.
- Daily hire employees in building and construction or the meat industry, and weekly hire meat industry employees whose job ends for seasonal reasons, are also outside the notice rules but are not offered as a choice.
- Pay in lieu of notice is your weekly figure times the weeks, a floor. The full rate for the hours you would have worked can differ from week to week, and term weeks are paid as weeks of salary.
- Tax is Schedule 11 withholding in 2026-27 on a payment outside a genuine redundancy. It assumes no other termination payment for this job or this year, is not your final tax, which your tax return settles, and does not cover super on notice pay.
- A deduction figure is the most an award allows, not an amount an employer must take. Deductions an employment contract allows are not modelled.
- Clause 32.2(b) of the Teachers award says the NES period applies to an employee over 45 with 2 years of service, without saying whether the award's 4 weeks still applies as a floor. The calculator shows the higher of the two and says so.
- It does not calculate redundancy pay, unused annual leave or long service leave paid when a job ends. The Redundancy Calculator, Annual Leave Calculator and Long Service Leave Calculator do.
- It is not the Fair Work Notice and Redundancy Calculator, which reads your award and asks for dates. Use that to check a figure your employer has given you.

Common questions.
How much notice do I need to give when I resign?
It depends on your award. 25 of the 26 awards here set 1 week for up to 1 year of service, 2 weeks for more than 1 and up to 3 years, 3 weeks for more than 3 and up to 5 years and 4 weeks for more than 5 years, counted at the end of the day you give notice. A teacher in a school gives 7 term weeks. Without an award, your contract or enterprise agreement sets it. A law firm employee with 4 years of service gives 3 weeks under clause 32.1 of the Legal Services Award, whose pay rates are on Legal Services Award Pay Rates.
Does the Fair Work Act set a notice period for resigning?
No. Section 117 sets the notice an employer must give, and the National Employment Standards set nothing for an employee who resigns. Resignation notice comes from your award, in a clause headed "Notice of termination by an employee", or from your enterprise agreement or contract.
Can my employer keep my pay if I do not give enough notice?
Under most awards, no more than 1 week of wages, and only if you are 18 or older. The standard clause lets the employer deduct up to that from wages owed under the award, never where it agreed to the shorter notice, and never where the deduction would be unreasonable in the circumstances. The Teachers award allows up to 2 weeks of wages at any age.
Do casual employees have to give notice when they quit?
Not under an award. Every award here applies its resignation clause to all employees except those section 123 of the Fair Work Act excludes, and casual employees are one of those groups, as are employees engaged for a set period, task or season. A contract or enterprise agreement can set its own terms, so check yours.
Do I give an extra week of notice if I am over 45?
No. The extra week for an employee over 45 with at least 2 years of service is something an employer adds under section 117(3)(b). Every standard award clause notes that an employee does not have to give additional notice based on age. The Teachers award ties a teacher's notice to the employer's, and the calculator note explains how its over-45 wording reads.
How much notice does my employer have to give me?
At least 1 week for up to 1 year of service, 2 weeks for more than 1 and up to 3 years, 3 weeks for more than 3 and up to 5 years and 4 weeks for more than 5 years, by your continuous service at the end of the day notice is given, plus 1 week if you are over 45 with at least 2 years of service. Your employer can pay it out instead at your full rate of pay. Casual employees, employees engaged for a set period, task or season, and anyone dismissed for serious misconduct are not owed it.
What is the notice period during probation?
Probation does not change it. An employer still owes notice under section 117, and Fair Work's own example is Gunter, dismissed 5 months into his probation, who is owed 1 week. Resigning on probation, the standard award table applies in the same way: 1 week for up to a year of service.
What is payment in lieu of notice?
Pay instead of working the notice period. Section 117(2)(b) lets an employer end the job without the notice period being worked if it pays what you would have earned over it at your full rate of pay, including loadings, allowances, overtime and penalty rates.
Is payment in lieu of notice taxed?
Yes, as an employment termination payment. Outside a genuine redundancy it is a non-excluded ETP, so Schedule 11 withholds 32%, or 17% if you are 60 or over on 30 June 2027, up to the smaller of the $270,000 ETP cap and the $180,000 whole-of-income cap less your other taxable payments that year, and 47% above it. The final tax is settled in your tax return. In a genuine redundancy it may fall inside the tax-free part, depending on your employment conditions. The ETP Tax Calculator works it out alongside any other ETP and unused leave paid in the same final pay. The Final Pay Calculator adds it to your wages and leave and shows the tax on each.
Can my employer pay me out instead of letting me work my notice?
When you resign, only one of the awards here says so outright. Clause 41.1(g) of the Hospitality Industry (General) Award 2020 lets the employer pay instead of having you work all or part of your notice, at the amount section 117 would require had the employer ended the job. The resignation clauses of the others are silent on it. When your employer ends the job, section 117 always allows a payment in lieu at your full rate of pay.
