Penalty Rates in Australia 2026-27

A penalty rate is the higher rate an award sets for ordinary hours worked at a time it treats as unsociable. There is no single national multiplier: the percentage and the base it applies to are both set by the award that covers the work. Below are the percentages three awards actually publish, and the 700 hourly figures they print against them.

The short answer

Ordinary hours on a Saturday are paid at 125% of the base hourly rate under all three awards here. A Sunday is 125% to 150% and a public holiday is 225%.

A casual is paid 150% on a Saturday, 150% to 175% on a Sunday and 250% on a public holiday. Those casual percentages already include the 25% loading rather than being multiplied by it.

What the percentage is applied to is not the same figure in every award, so two employees on the same percentage can be owed different money. That is set out below, award by award.

What a penalty rate is, and three things it is not.

A penalty rate applies to ordinary hours, the hours you were rostered to work, when those hours fall at a time the award treats as unsociable. It is expressed as a percentage of a base hourly rate, and it reprices the whole hour. An hour at 125% is not the ordinary rate with 125% added to it.

  • It is not overtime

    Overtime is about how many hours you worked. A penalty rate is about when you worked them. Each award prints its overtime rates in separate tables, and this page publishes none of them.

  • It is not a shift loading

    Retail clause 23.1 limits its shiftwork rates to employees engaged as shiftworkers, so a late finish is not automatically a shift rate. Those rates are published on the retail award page.

  • It is not casual loading

    The loading is paid because a casual has no paid leave. The penalty is paid because of when the hour fell. Casual Loading covers the loading itself.

The rows marked as percentage only are priced as a percentage plus a flat hourly amount. The rates schedule carries no dollar column for them and says instead: “Additional shift penalties apply in accordance with Table 14—Penalty rates.

One award makes the Sunday rate depend on your classification

The Fast Food Industry Award 2020 prints two Sunday percentages, and which one applies is set by the level you are classified at, not by the hours you worked:

  • 125% full-time and part-time, 150% casual, at level 1.
  • 150% full-time and part-time, 175% casual, at levels 2 and 3.

A page that prints one Sunday figure for fast food is wrong for whichever group it leaves out. In the tables further down, the column that does not apply to a classification is marked as not applicable rather than left blank or filled with a zero, because the award prints no rate there on purpose.

The casual percentage absorbs the loading, it does not compound it.

This is the single most valuable correction on the page, because the summaries at the top of these search results hedge it. They say a casual weekend rate “usually” incorporates the loading, “depending on the specific award”. In all 16 conditions across these 3 awards, the casual percentage is the full-time percentage plus exactly 25 points. There is no usually and no depending: 3 of 3 awards pass that check on every condition they publish.

What the award says

A retail Saturday is 125% for a full-time or part-time employee and 150% for a casual. The difference is the 25% loading, added in points.

What multiplying would give

125% multiplied by the loading is 156.25%. No award on this page states that figure. Multiplying applies the loading to the penalty as well as to the base, which is more than any of these awards asks for.

The loading itself, which awards publish it and which leave it to be worked out, is on Casual Loading.

The percentage applies to a different figure in each award.

Two employees can be on the same percentage and be owed different money, because the awards do not agree on what the percentage is a percentage of. One sentence saying “Sunday is 150% of your hourly rate” is right for a retail employee and wrong for a hospitality employee carrying an allowance.

    Percentage of the ordinary hourly rate

    ordinary hourly rate means the minimum hourly rate for an employee plus any all-purpose allowances to which the employee is entitled.

    Stated in Table 14—Penalty rates. The dollar figures the schedule prints are calculated on the minimum hourly rate alone, so for anyone entitled to an all-purpose allowance they are a floor rather than the entitlement, and the allowance has to be added first.

It separates the collision structurally instead: clause 23.1 says “Part 6 applies only to persons specifically employed to do shiftwork.” and the schedule then splits shiftworkers into their own tables.

  • Hospitality Industry (General) Award 2020Clause 29.3

    Subject to clause 29.3(c), where more than one penalty rate would be payable for hours worked at a particular time, the employer must pay the employee the highest applicable penalty rate, but no other applicable penalty rate is payable.

A cent of difference is the exact error a competing summary published on this query, so the check is not decorative.

What is not here, and why.

Overtime is not here. Overtime prices hours beyond the ordinary ones, and none of the penalty clause tables in these three awards states an overtime percentage. SCHADS penalty rates are not here either: MA000100 publishes no penalty table, and its overtime is written as time and a half and double time rather than as numerals, so putting an hourly figure on it would mean inventing one.

The percentages above are the same for a full-time and a part-time employee, and a casual is on its own column. The part-time question has its own answer, because what changes for a part-timer is which hours count as ordinary ones.

  • Overtime

    Overtime is paid for hours beyond the ordinary ones. The penalty clause tables in these awards state no overtime percentage, so no overtime figure appears anywhere on this page.

  • Retail shiftwork

    Retail limits its shiftwork rates to employees specifically employed as shiftworkers, and those tables are not published here. A late roster does not by itself put you on a shift rate.

  • Hospitality evening and night dollars

    Two conditions are a percentage plus a flat hourly amount, and the rates schedule prints no dollar column for either. They appear here exactly as the award states them and never as an hourly figure.

  • SCHADS penalty rates

    MA000100 publishes no penalty rate table and states its overtime in words rather than numerals. Extracting it would mean converting English into figures the award never printed, so this site publishes none of it.

  • Junior and apprentice scales

Penalty Rates questions, answered.

What are penalty rates?

A penalty rate is the higher rate an award sets for ordinary hours worked at a time it treats as unsociable, such as a weeknight, a Saturday, a Sunday or a public holiday. It is written as a percentage of a base hourly rate and it reprices the whole hour rather than adding to it. Across the three awards read for this page a Saturday is 125% for a full-time or part-time employee, a Sunday is 125% to 150% and a public holiday is 225%. There is no single national penalty rate, because the percentage and the base are both set by the award that covers the work.

What are the Saturday and Sunday penalty rates in Australia?

It depends on the award. Under the General Retail Industry Award 2020 a Saturday is 125% of the minimum hourly rate and a Sunday is 150%. The Hospitality Industry (General) Award 2020 sets the same two figures, 125% and 150%, but of the ordinary hourly rate rather than the minimum hourly rate. The Fast Food Industry Award 2020 pays 125% on a Saturday, and on a Sunday it pays 125% at level 1, and 150% at levels 2 and 3. A casual is paid 150% on a Saturday and 150% to 175% on a Sunday, loading included.

Is a casual paid the penalty rate as well as the 25% casual loading?

No, and this is the question most often answered with a hedge. The casual percentage an award prints already contains the loading. In all 16 conditions across these three awards the casual percentage is the full-time percentage plus exactly 25 points, never the full-time percentage multiplied by 1.25. A retail Saturday is 125% full-time and 150% casual. Multiplying gives 156.25%, which no award states.

Is Sunday double time?

Not in any of these three awards. A Sunday is 125% to 150% of the base rate for a full-time or part-time employee and 150% to 175% for a casual, so double time is above what all three publish. The figure that does reach and pass double time is the public holiday, at 225% full-time and 250% casual. Other awards not read for this page set their own percentages, and some are higher.

What time do weeknight penalty rates start?

Each award draws the line in its own place. The General Retail Industry Award 2020 starts its weeknight penalty at 125% for hours after 6.00pm. The Fast Food Industry Award 2020 pays 110% between 10.00pm and midnight and 115% after midnight and before 6.00am. The Hospitality Industry (General) Award 2020 prices its evening and night hours as a percentage plus a flat hourly amount instead, 100% plus $2.95 per hour or part of an hour and 100% plus $4.42 per hour or part of an hour, and publishes no per classification dollar figure for either.

Are penalty rates cumulative?

In the Hospitality Industry (General) Award 2020, no: clause 29.3 says the employer must pay the highest applicable penalty rate and no other. The General Retail Industry Award 2020 and the Fast Food Industry Award 2020 contain no equivalent clause. Neither text says they add and neither says they do not, so this page states only what the awards state. Retail separates the question structurally instead, by putting shiftworkers in their own tables under clause 23.1.

Why does this page cover only three awards?

Because these three awards print a penalty table that can be checked against itself: a percentage row, a dollar row and a base column in the same table. Retail shiftwork rates are not published here, because the retail shiftwork tables cannot be read reliably from the award text. The SCHADS award, MA000100, publishes no penalty table at all and states its overtime in words rather than percentages, so no SCHADS penalty rate appears here either.
